AN electrical product sales representative has sued Minister in the Prime Minister’s Department Shahidan Kassim and two others for alleged breach of agreement involving rice cookers.
Florence Lee Jye Wen named Padang Besar MP Zahidi Zainul Abidin and Perlis Umno treasurer Rozabil Abdul Rahman as the second and third defendants.
Lawyer Lavinia Kumaraendran, who represented Lee in case management in chambers today before judicial commissioner Wan Ahmad Farid Wan Salleh, told reporters that the court had set September 13 for another case management.
She said the court had fixed trial for two days from June 25 next year if the parties could not reach a settlement.
Lee, 29, in her statement of claim, said on May 15, 2015, she was approached by a salesperson from an electrical product company about Perlis Umno's request for 60,000 units of 1.8l rice cookers with the Umno logo and Shahidan’s initials, “DSSK” (Datuk Seri Shahidan Kassim), on them.
She said on June 3 that year, she received an official letter from Perlis Umno, stating that Shahidan wanted to buy 60,000 units of 1.8l rice cookers, costing RM74 each, which would be delivered in stages on the instructions of the minister.
Lee said the letter, signed by Perlis Umno executive secretary Kamarudin Abdul, stated that the rice cookers would be supplied to three areas – Arau, Kangar and Padang Besar – with each area getting 20,000 units.
She said the sales agreement involved RM4.4 million, where the cost of the 60,000 rice cookers had been set at RM74 per unit.
Lee said following the agreement and requisition, she proceeded to order 10,000 rice cookers from the company and prepared stickers with the logo and initials to place on the rice cookers.
She said she sent 2,000 rice cookers, on the instructions of Shahidan, to the service centre in Kubang Gajah, Arau, between October 23, 2015, and April 6 last year, but the balance of 8,000 rice cookers were not delivered as Perlis Umno did not issue instructions and failed to pay RM592,000 for them.
Lee said she was paid only RM148,000 of the RM4.4 million, and that she could not sell the 8,000 rice cookers to a third party as they had the Umno logo and Shahidan's initials on them.
She is claiming RM592,000 for the outstanding payment, and seeking special and general damages, interest and other costs deemed fit by the court.
The defendants, in their statement of defence filed on May 17, claimed that they had never communicated with the salesperson that Lee mentioned and never intended to buy 60,000 units of rice cookers. – Bernama, August 29, 2017.
